Machinery Sales Direct business account terms

1. Your account

The account is for a business with an ABN. The person who makes it confirms they can accept these terms for the business.

Keep your password to yourself. You are responsible for what is done with your account. Tell us straight away if you think someone else has used it.

We check every new account before anything you enter goes on our site.

2. What you list

You may list machines you own or are entitled to sell or hire out. Machines for sale must be worth $2,000 or more. Trucks and cars can't be listed for sale through an account.

Everything you give us (description, photos, price or rates, location, faults you know of, and whether money is owed on a machine) must be accurate, and you keep it up to date.

Never use "sold as is", "no warranty" or "no refunds" wording in a listing.

You own, or have permission to use, every photo and word you give us, and you let us publish them while the listing is up and show them in our own advertising of the site.

3. How listings go live

We check each listing before it goes live and after you change it. We may resize photos and correct obvious typing errors, but we don't change your price, rates or facts without asking you.

We may decline a listing, or take one down, if we reasonably think it is misleading, out of date or unsafe, and we will tell you why.

We don't promise any number of views, calls, sales or hires. We show you the views and taps we count.

4. Machines for sale (MSD Listed)

Your listing shows your business name, phone number, website and suburb, and buyers contact you. You are the seller: the price, payment and the sale are between you and the buyer. We never agree a price, take a deposit or sign anything for you.

Your first 10 machines are free to list. For each of them you pay 1% of the sale price, at least $20 and at most $80, plus GST, when it sells while it is listed with us.

From your 11th machine, each new listing costs $49 plus GST when it goes live, and nothing when it sells. That fee covers the machine's listing until it sells or you take it down, and isn't refunded if you take it down early.

Machines over $50,000 are quoted: ring us.

Tell us, or mark it in your account, within 2 business days when a machine sells or is no longer for sale.

5. Machines for hire

Your listing shows your business name, phone number, website and location, and hire customers contact you. Every hire is a contract between you and your customer, on your own terms. MSD is not your agent for any hire and is not responsible for any hire or any machine.

Listing is free until our site sends you your first customer contact: the first time someone taps the call button on one of your hire listings, or asks to book one. After that it costs $49 plus GST a month for up to 30 machines, starting the month after that first contact. More than 30 machines are quoted.

For each machine you confirm it is maintained, inspected, registered where required and safe to hire, and that you hold the insurance and licences your hire business needs.

Tell us, or change it in your account, within 2 business days when a machine stops being available or its rates change.

6. Paying us

We send a tax invoice for every fee. Monthly fees are invoiced in advance. You pay within 14 days of the invoice. All prices are plus GST.

We may take your listings down if an invoice is more than 30 days overdue.

We give you 30 days' notice by email of any change to our fees. You can close your account before the change starts.

7. Your information

We use your business details to run your account and to contact you about it. The details shown on your listings are public: that is how customers reach you.

We count views of your listings and taps on their buttons without identifying anyone, and show you the totals. Our privacy policy at machinerysalesdirect.com.au/privacy explains the rest.

8. Ending

You can close your account at any time by telling us by email. We can close it with 30 days' notice by email, or straight away if you seriously or repeatedly break these terms.

When an account closes we take its listings down within 7 days. Fees already owed, and monthly fees for months already started, are still payable.

9. Liability

Each of us is responsible for our own acts, our own staff and the goods we own. MSD isn't responsible for any sale or hire between you and a customer.

Neither of us is liable to the other for indirect or consequential loss, including loss of profit. Nothing in these terms limits a right that the law says can't be limited.

10. General

We are independent businesses. These terms don't create a partnership, joint venture, agency or franchise, and neither of us can bind the other. You can advertise anywhere else.

Either of us may pass these terms to a buyer of our business, with notice.

We may change these terms with 30 days' notice by email. If you don't agree to the change, you can close your account before it starts.
