Machinery Sales Direct private seller terms
Version 2026-10-19-private
These terms are between Ride On Mower Outlet Warehouse Pty Ltd (ACN 684 101 139, ABN 21 684 101 139), trading as Machinery Sales Direct, 14/70 Flanders Street, Salisbury QLD 4107 ("MSD", "we"), and you, the person who makes the account to sell a machine of your own. You accept them by ticking the box when you make your account.
1. Your account
You must be 18 or over. Keep your password to yourself; you are responsible for what is done with your account. Tell us straight away if you think someone else has used it.
If you sell machinery as a business, make a business account instead.
2. What you can list
A machine you own, or have the owner's written permission to sell, worth $2,000 or more. Trucks and cars can't be listed. Machines over $50,000: ring us.
You tell us if any money is owed on the machine (finance or a security interest) and you clear it before the buyer takes it.
Everything you give us (description, photos, price, hours, location and any faults you know of) must be true, and you keep it up to date. Never use "sold as is", "no warranty" or "no refunds" wording in a listing.
You own, or have permission to use, every photo and word you give us, and you let us publish them while your listing is up.
3. The listing fee
One fee per listing, set by the asking price when you pay, including GST: $20.90 for an asking price of $2,000 to $4,999; $31.90 for an asking price of $5,000 to $9,999; $42.90 for an asking price of $10,000 to $24,999; $53.90 for an asking price of $25,000 to $50,000.
You pay it by card when you send the listing to us for a check. It covers the listing until the machine sells or you take it down. Changing the price later doesn't change the fee, and putting the same machine back up doesn't cost again.
Listings sent for a check before we start taking card payments are free, up to 3 per account, and stay free until they sell or you take them down.
If we decide not to put your listing up, we refund the fee in full to your card. Once it has gone live, the fee isn't refunded if you take it down or it sells early, except where the law gives you a right to a refund.
4. How listings go live
We check each listing before it goes live and after you change it. We may resize photos and fix obvious typing errors, but we don't change your price or facts without asking you.
We may decline a listing, or take one down, if we reasonably think it is misleading, out of date or unsafe, and we will tell you why.
We don't promise any number of views, calls or a sale. We show you the views and taps we count.
5. Buyers
For each listing you choose how buyers reach you. Either your first name and phone number show on the listing and buyers ring you, or your number stays private: buyers send us an enquiry, and we pass the genuine ones on to you with their details.
You are the seller. The price, payment, inspection and handover are between you and the buyer. MSD is not your agent, never agrees a price, takes a deposit or signs anything for you, and isn't part of the sale.
Tell us, or mark it in your account, within 2 business days when your machine sells or is no longer for sale.
6. Your information
We use your details to run your account and to contact you about it. If you choose to show your phone, your first name, phone number and suburb are public on that listing; your surname and email never are.
We count views of your listings and taps on their buttons without identifying anyone, and show you the totals. Our privacy policy at machinerysalesdirect.com.au/privacy explains the rest.
7. Ending
You can close your account at any time by telling us by email; your listings come down within 7 days. We can close it with 30 days' notice by email, or straight away if you seriously or repeatedly break these terms.
8. Your rights
Nothing in these terms takes away a right you have under the Australian Consumer Law or any other law that can't be excluded.
We may change these terms with 30 days' notice by email; a change never affects a fee you've already paid. Queensland law applies.
